TERMS AND CONDITIONS FOR USE 
These terms and conditions for use (“Terms”) apply to the internet sales website www.eleme.lt (“Website”) and shall be binding to all persons visiting and using this Website (“Users”).
Prior to beginning using the Website, we kindly ask that you read these Terms. By using the Website you thereby confirm that you have read in full and agree with these Terms.

The Seller does not guarantee that the information on the Website is always precise and comprehensive, except for the information published on the Website in accordance with the legislative requirements of the Republic of Lithuania or which derive from the contractual relations between the Seller and Users. Each User shall have the responsibility to evaluate the content and usefulness of the information on the Website. 
TERMINOLOGY USED ON THE WEBSITE
Various terminology is used in the documents published on the Website and depends on the content and objective of each specific document. For example:
The term “Buyer” is used in the distance sales contract to identify a natural or legal person who places an order and purchases a product on the Website.
The term “Buyer (Consumer)” is used in the distance sales contract to identify a person, who, pursuant to Section 1(3) of the Consumer Protection Law of the Republic of Latvia, is a natural person expressing the wish to purchase, purchasing or possibly purchasing or using a product for a purpose unrelated to the person’s economic or professional activity.
The term “Buyer (Legal Entity)” is used in the distance sales contract to identify a legal entity, which in the framework of its economic or professional activity expresses the wish to purchase, purchases or may purchase or use a product.
The term “Data Handler” is used in the Privacy Policy and Cookies Policy to identify the Seller as a personal data handler in accordance with the laws and regulations in force within the Republic of Lithuania and relevant European Union legislation regulating the processing of personal data of natural persons.
The term “User” is used in these Terms, the Privacy Policy and the Cookies Policy to identify any person visiting and using the Website, including “Buyers”. 


REGISTRATION
In order to purchase products offered on the Website, a User shall have the right to register and create a personal account on the Website (indicating their e-mail address, username and creating a password) where information about customer loyalty cards and discounts may be entered. The User shall have the right to order a product without registering on the Website.
After creating a username and password (“Access Data”) and completing registration, the User shall undertake to ensure that their Access Data shall not be disclosed to third parties. Access Data is confidential. The User shall be responsible for any action taken on the Website using their Access Data. If a third party purchases a product on the Website using the User’s Access Data, the Seller shall have the right to consider this party to be the User. If the User loses their Access Data, the User shall immediately inform the Seller by telephone or e-mail as indicated on the Website.
By registering or ordering a product on the Website, the User consents to the Seller as a personal data handler selecting, collecting, systemising and using all information and data, which the User has directly or indirectly disclosed on the Website. More information about personal data processing performed by the Seller is available in the Privacy Policy.
When registering or ordering a product on the Website, the User shall have the right to indicate and provide their consent as to whether they wish to receive news about products available on the Website, upcoming events, the Seller’s marketing activities, campaigns and news (“Advertising”). If the User does not wish to receive Advertising and has informed the Seller accordingly by informing the Seller in writing to the e-mail address [email protected], the Seller shall not send Advertising to the User. However, regardless of whether the User has indicated that they do not wish to receive Advertising from the Seller, the Seller shall have the right to send to the User’s indicated e-mail address important information, such as information related to the execution of the contractual obligations of the User (or the commercial operator represented by the User).
If the User wishes to delete their personal profile from the Website, the User shall inform the Seller by submitting a written notification to the Seller’s e-mail address [email protected] or doing so on their profile.


CHANGING THE WEBSITE ENVIRONMENT
The Seller shall have the right to discontinue the operation of the Website or separate sections thereof if this is necessary for the improvement or modernisation of the Website or other reasons. 


RESTRICTING RIGHT OF USE
The Seller shall have the right to restrict or revoke a User’s access to the Website, doing so at the discretion of the Seller and without prior warning, if the Seller has reason to believe that in using the Website the User may or already has violated these Terms, is attempting to harm the Seller, the operation of the Website or its security, or third parties. 


RESPONSIBILITY
The Seller shall not be held responsible for damages which may arise as a result of using the Website or the information published therein or due to the fact that a product offered on the Website, the Website or any part of it is for any reason unavailable or the functioning of the Website has been interrupted or suspended.


The Seller shall not be held responsible for independent access to the Website and the possibility to use it, if the User’s internet connection service or device used does not comply with the technical requirements for using the Website.


The Seller shall not guarantee the availability of the products presented on the Website. 


LINKS TO OTHER INTERNET SITES
The Website may contain links to third party internet sites. The Seller shall not be held responsible for the content of third party websites or the products and/or services offered therein, as well as for damages or harm incurred by the User while visiting these websites by using the text links on the Website. 


INTELLECTUAL PROPERTY RIGHTS
The Website is the property of the Seller. All intellectual property rights, including copyrights, trademarks and other property rights pertaining to the Website and information published therein are property of the Seller unless it is explicitly indicated that these rights belong to another person. Copying, dissemination, alteration, supplementation or reproduction of the content of the Website and the information published therein is prohibited without the written consent of the relevant owner of the intellectual property rights. It is prohibited to use the Website and information published therein for any other purpose than for information purposes for personal use.

APPLICABLE LAW
The operation of the Website is regulated by and these Terms are subject to the laws and regulations applicable in the Republic of Lithuania. Any dispute, disagreement, discord or claim arising out of the use of the Website or deriving from these Terms shall be resolved by a court of the Republic of Lithuania based on the jurisdiction determined by the laws and regulations of the Republic of Lithuania.
